CMAVision provides AI-generated property analyses including estimated valuations, comparable-sales analyses, investment grades (A–D / BUY / HOLD / PASS), rental income estimates, photo analysis, and educational negotiation insights — for informational and educational purposes only. Reports are not a substitute for professional appraisal, brokerage, legal, accounting, tax, financial, or investment advice.
Outputs are NOT appraisals under Fla. Stat. § 475.611(1)(a) or Title XI of FIRREA (12 U.S.C. § 3350). No Report may be referred to, construed, or submitted as an appraisal report under Fla. Stat. § 475.612(1), or used in any federally related transaction under 12 U.S.C. § 3350(4). CMAVision is not certified or licensed under Part II of Chapter 475, Florida Statutes. Users requiring a legally recognized appraisal must engage a Florida-certified or Florida-licensed real estate appraiser.
CMAVision is not licensed under Part I of Chapter 475, Florida Statutes (Fla. Stat. § 475.01 et seq.). CMAVision does not act as a broker, agent, or representative for any user; does not negotiate, procure, or solicit real estate transactions; and does not receive compensation contingent on any transaction. Any negotiation insights in a Report are general educational content only. CMAVision's sole compensation is a flat software subscription fee unrelated to any specific transaction.
CMAVision is not registered as an investment adviser under the Investment Advisers Act of 1940 (15 U.S.C. § 80b) or Fla. Stat. § 517.12. Investment grades are educational algorithmic summaries, not personalized investment advice. The Service may NOT be used to evaluate any security including REIT shares, fractional interests, syndications, partnership interests, LLC interests, DST interests, or any pooled investment vehicle.
No attorney-client relationship is formed by use of the Service. Nothing in any Report constitutes legal advice.
Before making any real estate purchase, sale, financing, or investment decision, obtain: a professional appraisal from a Florida-certified appraiser; a CMA from a Florida-licensed broker; and advice from your own legal, tax, and financial advisers.
AI systems can and do make errors — including factual errors, mathematical errors, hallucinations, and errors of judgment. AI does not visit, physically inspect, or verify any property. AI has no access to non-public information. Outputs are only as accurate as the underlying data, which may be stale or incomplete.
Reports use Anthropic Claude (Anthropic, PBC) and Perplexity AI, Inc., subject to their terms and privacy practices. User-submitted content is transmitted to these providers solely to generate your Report. CMAVision does not sell such content to third parties.
All data is provided "as-is" without warranty. County records may not reflect recent sales, unpermitted improvements, liens, or ownership transfers. Third-party estimates (Zillow, Redfin, Realtor.com, ATTOM, RentCast, PriceLabs) are reference data only. AI valuations and grades are probabilistic estimates, not determinations of fact.
Reports expire 60 days from generation. Market conditions, property status, tax assessments, STR regulations, and insurance rates change continuously. Expired Reports must not be relied upon for any purpose.
You agree to independently verify all material information with qualified licensed professionals before making any decision.
You agree NOT to use the Service or any Report to:
Real estate investment involves substantial risk, including potential total loss of capital. You expressly assume all risk associated with any investment, purchase, sale, lease, financing, or other financial decision made using information from this Service. The Service does not guarantee any investment outcome. Past Report accuracy does not guarantee future accuracy. You are solely responsible for verifying all data before acting on it.
Nothing in these Terms limits liability for fraud, intentional misconduct, or non-waivable consumer-protection rights under FDUTPA (Fla. Stat. § 501.201 et seq.).
You agree to defend, indemnify, and hold harmless CMAVision and its founders, officers, employees, agents, and affiliates from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service or any Report; (b) your violation of these Terms; (c) any financial decision made by you or any third party based on any Report; (d) your violation of any applicable law; (e) your negligence or willful misconduct; (f) any claim that you represented a Report as a licensed appraisal.
You represent and warrant that you own or have all rights to submit User Content; that photographs are taken with appropriate legal authorization; and that User Content does not violate any applicable law or third-party right.
By submitting User Content, you grant CMAVision a non-exclusive, worldwide, royalty-free license to process, store, analyze, and use User Content solely for generating your Report and improving the Service. CMAVision does not sell User Content to third parties.
The Service — including its software, algorithms, methodology, data pipelines, user interface, branding, and underlying technology — is the exclusive intellectual property of CMAVision, protected by U.S. copyright law and trade secret law.
Subject to compliance with these Terms, CMAVision grants you a limited, non-exclusive, non-transferable, revocable license to access the Service and use Reports solely for your personal, internal, non-commercial real estate analysis purposes. CMAVision reserves the right to use anonymized, aggregated, de-identified data for product improvement and commercial purposes.
⚠️ NOTICE: ARBITRATION AND CLASS ACTION WAIVER. This Section affects your legal rights including your right to sue in court and your right to a jury trial. You may opt out within 30 days — see Section 11.7 below.
Before initiating arbitration, send written notice to legal@cmavision.app describing the dispute. CMAVision has 60 days to resolve it informally before either party may initiate arbitration.
Except as provided in Section 11.4, all disputes arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator in Pinellas County, Florida.
This Section does not apply to: (a) claims in small claims court; (b) injunctive relief to protect intellectual property; (c) any "sexual assault dispute" or "sexual harassment dispute" as defined in 9 U.S.C. § 401 (EFAA 2022) — applicability determined by a court, not an arbitrator, per 9 U.S.C. § 402(b).
This Section applies to disputes arising on or after the date you first accepted these Terms. It does not apply to claims that accrued before that date.
You acknowledge this Section was presented clearly and conspicuously before you clicked "I Agree," consistent with Eglin Federal Credit Union v. Baird, 400 So. 3d 643 (Fla. 1st DCA 2024).
Email legal@cmavision.app with subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Include your name and account email. Opting out does not affect any other provision.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except that the Federal Arbitration Act (9 U.S.C. §§ 1 et seq. and §§ 401–402) governs Section 11.
For claims not subject to arbitration, you consent to exclusive jurisdiction and venue in the state and federal courts of Pinellas County, Florida.
Consistent with 15 U.S.C. § 8403 (ROSCA), all material subscription terms — recurring price, billing frequency, auto-renewal date, and how to cancel — are clearly disclosed before you provide billing information.
Cancel at any time via: Account Settings → Cancel Subscription, or email cancel@cmavision.app. Cancellation takes effect at the end of the current billing period. No telephone call required. No save-attempt barrier.
For annual subscriptions, CMAVision will send a reminder email at least 7 days before your renewal date.
CMAVision complies with the Florida Information Protection Act (Fla. Stat. § 501.171) and maintains reasonable security measures. In the event of a data breach, CMAVision will notify affected users no later than 30 days after determining a breach occurred, per Fla. Stat. § 501.171(4)(a).
Consistent with Fla. Stat. § 501.715, CMAVision does not sell your sensitive personal data — including precise geolocation data as defined in Fla. Stat. § 501.702(22) — without your prior consent. CMAVision does not sell your personal information to third parties.
Generating Reports requires transmitting property addresses, agent notes, and photographs to third-party AI providers (Anthropic, Perplexity, Google). By using the Service, you consent to such processing. CMAVision transmits only the minimum information necessary.
Report data is retained for up to 12 months from generation, then deleted or anonymized. Request deletion: support@cmavision.app.
Material changes will be communicated via email and in-app notification at least 30 days before taking effect, consistent with Eglin Federal Credit Union v. Baird, 400 So. 3d 643 (Fla. 1st DCA 2024). Continued use after the effective date constitutes acceptance.
CMAVision may suspend or terminate your access at any time, with or without cause. Upon termination, all licenses granted to you immediately terminate. Sections 1–5, 7–12, and 14 survive termination.
Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and CMAVision.
Severability: If any provision is unenforceable, it shall be modified to the minimum extent necessary; remaining provisions continue in full force.
No Waiver: Failure to enforce any right or provision shall not constitute a waiver.
Assignment: You may not assign your rights without CMAVision's prior written consent.
